Driving whilst using a mobile phone Law in Scotland

The law makes it an offence to use a hand-held mobile phone while driving. This means that drivers cannot pick up a mobile phone in their hand and use it while driving. The offence applies equally to motorcycle riders as it does to other motor vehicle drivers.

The law also covers “other hand-held interactive communication devices” such as tablets and potentially e-readers.

Persons who use a hand-held mobile phone while driving can receive a fixed penalty notice or find themselves the subject of a criminal prosecution. The consequences of a conviction can de disastrous. The offences carries the mandatory imposition of 6 penalty points which can in some cases result in the loss of a person’s licence under the totting up provisions. It can also have an implication on your insurance premiums and in some cases, employers may no longer permit you to drive under their policy of insurance. 

However, the offence only captures certain types of use. It does not, for instance apply, to those using the “standalone” functions of a phone.
