COVID-19 - How is it affecting your business?

The past few weeks have been challenging for business. Many have required to adapt their working practices at short notice in order to continue to service their client base effectively. Many businesses have turned to technology and working remotely to replace more traditional methods.

However, even for those businesses who have comparatively made a success of these new working practises, there will inevitably be a desire and in some cases a necessity to return - at least in part - to the more traditional comforts of the office as soon as possible.

What's happening in Scotland?

However, a word of warning: In Scotland, legislation has recently been introduced which now places an obligation on business to implement social distancing measures in their premises.

The Health Protection (Coronavirus) (Restrictions) (Scotland) Amendment (No.2) Regulations 2020 came into force on 21st April 2020. Hitherto, businesses not specified within the Regulations were subject only to the guidance issued by the Scottish Government about social distancing.

It is now the position that people who are responsible for carrying on a business or providing a service, must take all reasonable measures to ensure the following during this emergency period:

  • (a) that a distance of two metres is maintained between any persons on the premises (except between two members of the same household, or a carer and the person assisted by the carer),
  • (b)that the business only admits people to its premises in sufficiently small numbers to make it possible to maintain that distance,
  • (c)that a distance of two metres is maintained between any person waiting to enter its premises (except between two members of the same household, or a carer and the person assisted by the carer).

Business that fail to comply with these regulations will be deemed to have committed an offence and may be prosecuted and/or fined.
