Scottish Government Set to Tackle Misogyny

Last month, the Cabinet Secretary for Justice Humza Yousaf announced that Scottish Ministers will meet to discuss how criminal law can be strengthened in order to better tackle misogynistic behaviour.

Mr Yousaf stated that “The Scottish Government is working with a range of partners” including education, legislation, and law enforcement to combat violence against women and young girls, including “unacceptable attitudes and harmful behaviour”, in a bid to update Scotland’s hate crime laws to prevent gender-based violence.

The Cabinet Secretary went on to argue that without taking action to wipe out gender prejudice, this sort of behaviour could continue to spread throughout society. However, he admitted that the viewpoints on the specific course of action required to do so differ wildly.

This announcement comes after Lord Bracadale was tasked by the Scottish Government to review the country’s legislation on hate crime in January 2017 to deem whether the existing laws were suitable. In his review report published on 31st May 2018, he recommended that there should be a consultation on hate crime legislation.

Current legislation allows existing offences to be aggravated by prejudice, which if applicable, will be recorded and taken into consideration during sentencing. However, the Government is accepting of Bracadale’s recommendation to consolidate all hate crime under one new statute, which will become the basis for how they will deal with misogyny.
